Expungement of your Criminal Record
In misdemeanor and many felony cases, once you have completed your sentence and/or your period of probation, you are entitled to have your record of conviction cleared (expunged). People have many reasons for wanting to clear their records. Often, people are concerned about having to disclose their conviction record when they apply for a job or are seeking a higher education.

The process of expungement involves the filing of a petition with the court and the payment of the appropriate court fee. The petition requests that the court withdraw the individual's plea of guilty or no contest, enter a plea of not guilty and dismiss the charge.

The expungement petition cannot be brought by someone convicted of violations of California Vehicle Code sections 2800, 2801, 13555, 42001 and/or Penal Code section 12021. Sex offenses and the requirements of registration as a sex offender may not be covered by the expungement process either.

You should be aware that the federal government need not honor the expungement, nor does an expungement of a conviction relieve a person from having to disclose it in an application for public office or on professional license applications such as for attorneys, physicians, educators and insurance agents.



Fee for Expungement
The fee for a misdemeanor expungement is $795.00 per charge in Los Angeles County. The fee for a felony expungement is $995.00 per charge in Los Angeles County. The fee per charge outside of Los Angeles is $995.00 for misdemeanor convictions and $1,195.00 per charge for felony convictions. In addition there is a $125.00 filing fee per charge.


Fee for Information Research
The expungement fees listed above assume that all of the information requested in the on line intake form has been provided. In the event that information is unavailable to the petitioner we will conduct the research necessary to obtain the information for an additional fee of $250.00 per conviction.


What's the Procedure ?
If you wish the Law Offices of Rosen & Zimmerman to expunge your record, all that is required is that you fill out the on-line inquiry form. Once you've completed the form the total fee for your expungement will be computed and shown to you on the screen. Next you will be directed to an on-line payment screen where the charges for your expungement can be reviewed by you and where you will have the ability to charge the fees to a major credit card. Once your authorization is complete your information will be reviewed by an attorney in our office and in a few days a declaration, which accompanies your expungement petition, will be forwarded to you by mail for your signature. Once your declaration is returned to the law office your petition, your declaration and a proposed order of expungement will be forwarded to the appropriate court for review and execution. The signed court order expunging your record will be forwarded to you by mail from the law office, usually within thirty days.
